Plain terms for a simple job: we come to your car, you pay when it's done.

1. Agreement to Terms

These Terms of Service (“Terms”) govern your use of the website located at icyshinedetailing.com (the “Site”) and the mobile vehicle detailing services (the “Services”) provided by Hleb Staver, an independent sole proprietor doing business as IcyShine Detailing (“we,” “us,” or “our”). By checking the “I agree to the Terms of Service” box at booking, or by otherwise using the Services, you (“you,” “your,” or “Customer”) affirmatively agree to be bound by these Terms. If you do not agree, do not check that box, book, or use our Services.

The Services are intended for users who are at least 18 years old. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian.

2. Description of Services

We provide mobile vehicle detailing services throughout the San Francisco Bay Area, with priority service in Walnut Creek, Concord, Pleasant Hill, Lafayette, Martinez, Danville, San Ramon, Dublin, Pleasanton, Alamo, Blackhawk, and Livermore. Requests from other Bay Area locations, including San Jose, Berkeley, Oakland, and San Francisco, may be accepted at our discretion depending on distance, order value, and scheduling availability.

We do not operate a fixed drop-off location; all Services are performed at the location you designate at the time of booking. Access to on-site water and electricity is preferred and may improve service efficiency, but is not required for most Services — our team carries the equipment necessary to perform them independently. The engine bay detailing add-on may require access to on-site water and/or electricity; this will be confirmed with you at booking if you select this add-on. The location must otherwise meet the safety and access requirements described in Section 3.

Package prices listed on the Site are the full prices for the vehicle type and condition you select at booking. Pricing varies by vehicle type and condition, and all rates are published on the Site. If the vehicle presented at the appointment differs from what was selected at booking, pricing is adjusted as described in Section 7.

3. Bookings & Property Access

All appointments are subject to availability and confirmation by us.

You must ensure the vehicle is accessible in a safe and lawful environment. We reserve the right to decline or reschedule service if conditions are unsafe or hazardous, including but not limited to: an unleashed aggressive animal at the location, active construction or structural hazards near the vehicle, lack of reasonable space for our technician and equipment to work safely, or any other condition that our technician reasonably determines poses a risk to their safety or the safe performance of the Service.

We provide estimated arrival windows, not guaranteed arrival times. Traffic, weather, equipment issues, or the duration of a prior appointment may affect arrival time.

We reserve the right to reschedule a booking due to weather, equipment failure, staffing, or other circumstances beyond our reasonable control. We will notify you as soon as reasonably possible.

4. Payment Terms

We accept payment by credit/debit card or cash. Card payments are processed securely through Square. We do not store your full card details on our own systems.

Depending on the option selected at booking, payment is either:

  • Prepaid by card at the time of booking; or
  • Paid upon completion of the Service, by card or in cash.

By submitting card payment, you authorize us to charge the amount associated with the selected Service, any applicable add-ons, and any fees described in Section 5 (Cancellation & Rescheduling) or Section 7 (Surcharge Policy).

Detailing services are generally not subject to California sales tax. If any portion of your order includes the sale of physical products subject to state or local sales tax, such tax will be added at checkout or invoicing.

We encourage you to contact us first if you have any concern about a charge, so we can resolve it quickly under Section 9. This does not affect your right to file a chargeback or payment dispute with your card issuer at any time.

If payment is not received upon completion of the Service as agreed, the unpaid amount becomes immediately due and may be referred to a collections agency or pursued through small-claims court. We reserve the right to require full prepayment for any future bookings from a customer with an unpaid balance, and to decline future bookings until the balance is paid. Non-payment does not entitle you to keep the benefit of a completed Service without payment, and does not affect our rights under Section 13 (Indemnification) or applicable law.

5. Cancellation & Rescheduling

We require at least 24 hours’ notice to cancel or reschedule an appointment at no charge.

Cancellations or rescheduling requests made with less than 24 hours’ notice, or failure to provide access to the vehicle at the scheduled time and location (“lockout”), will result in a $50 fee. This flat fee reflects our reasonable, good-faith estimate of the travel time, fuel, and scheduling costs typically incurred when a booked appointment is cancelled or rescheduled on short notice, and is not a penalty. Because these costs are difficult to calculate precisely for each individual appointment, we apply a single reasonable estimate across all bookings in our service area.

Repeated late cancellations or no-shows may result in us requiring prepayment for future bookings, or declining to accept further bookings from you.

6. Customer Responsibilities

By booking a Service, you agree to:

  • Remove all personal belongings, valuables, and cash from the vehicle prior to service. We are not responsible for the loss of, or damage to, personal items left inside the vehicle.
  • Provide safe and lawful access to the vehicle at the scheduled time and location, as described in Section 3.
  • Accurately disclose the vehicle’s condition at the time of booking, including any pre-existing damage, aftermarket modifications, worn or defective paint/clearcoat, loose trim, or hazardous contaminants (see Section 7).

Failure to disclose a hazardous or unusual condition at the time of booking may void the guarantee described in Section 9 and may result in the fee described in Section 7 being applied on-site.

7. Surcharge Policy for Excessive Vehicle Condition

Pet hair removal and odor treatment are available as standard add-on services at the prices listed on our Site (see Section 8). This section addresses vehicle conditions beyond what our standard packages and add-ons are designed to handle.

Vehicle condition is assessed using the following scale: Light — routine dirt and dust, no significant staining or odor; Normal — visible dirt, minor stains, light pet hair; Dirty — heavy staining, embedded dirt, significant pet hair or odor requiring extended treatment time. This scale is provided to you at booking when selecting your vehicle’s condition.

Vehicle type adjustment. Our pricing varies by vehicle type (e.g., Coupe/Sedan, Truck/SUV, Large SUV/Minivan). If the vehicle presented at the appointment differs from the type selected at booking, the price will be adjusted to the correct rate for the actual vehicle type according to our published pricing on the Site. We will notify you of the adjustment before work begins.

Vehicles arriving with severe contamination beyond this scale — including but not limited to biohazards (blood, vomit, urine, feces, mold) or heavy off-roading residue — will incur an additional $50 fee, separate from our standard condition-based pricing. We will notify you of this fee before it is applied, and you may choose to accept it or decline the additional work.

If a hazardous or unusual condition described in this Section was not disclosed at booking as required by Section 6, and you decline the resulting fee, we reserve the right to decline to perform the Service. In that case, the cancellation fee described in Section 5 will apply, as the undisclosed condition prevented us from completing the appointment as booked.

8. Add-On Services

We offer optional add-on services that may be selected at booking or added after an on-site inspection, including pet hair removal, odor treatment (Bio-Bombs), engine bay detailing, and headlight restoration. Current pricing for each add-on is listed on our Site. Pet hair removal is only available with the Mini Detail package, as this service is already included as part of our Full Detail and Interior Reset packages. Add-ons are billed separately and become part of the same order as the base Service.

9. Satisfaction & Redo Policy

Your satisfaction matters to us. If you are unsatisfied with any aspect of a completed Service:

  • Contact us within 24 hours of service completion at +1 (925) 263-6615 or icyshine.detailing.ca@gmail.com, describing the issue.
  • Where there is clear evidence of an incomplete or unsatisfactory result, we will offer to redo the affected portion of the Service at no additional cost.

Refunds are reviewed on a case-by-case basis. A refund may be limited or denied if: the issue is not reported within the window above; you decline a reasonable offer to redo the work where a redo is genuinely capable of resolving the specific issue you reported; the vehicle has been independently cleaned, repaired, or altered before we have had an opportunity to inspect it; or the issue relates to a pre-existing condition that was not disclosed at booking, as described in Section 6.

Where the reported issue cannot reasonably be resolved by redoing the work — such as damage to the vehicle or its components — we will instead offer an appropriate remedy, which may include a partial or full refund, or reimbursement of repair costs, based on the nature of the issue.

If you do not make the vehicle reasonably available for an offered redo within a reasonable time (e.g., you stop responding to scheduling attempts), this will be treated the same as declining the redo offer. However, if you are genuinely unable to make the vehicle available for reasons outside your control (such as having sold the vehicle or relocated outside our service area), we will instead offer an appropriate alternative remedy, which may include a partial or full refund.

We may take before/after photographs of the vehicle for quality assurance and dispute-resolution purposes. Declining to allow this documentation may limit our ability to evaluate a satisfaction claim. If you decline, any subsequent dispute about the quality of the completed work will be resolved based on the information available to us, and the absence of documentation will not be construed in your favor. See our Privacy Policy for more information on how photographs and other personal information are used and retained.

This policy does not affect any non-waivable rights you may have under California consumer protection law.

10. Membership / Recurring Plans

We offer a recurring membership plan (“Plan”) providing service equivalent to our Mini Detail package on a recurring basis. To enroll, you must first purchase a one-time Full Detail service (priced according to your vehicle type and condition); the Plan becomes active following completion of that service.

Plans are available as:

  • Monthly — billed on the 1st of each month.
  • Quarterly — billed on the 1st of the month, once every three months.

Pricing varies by vehicle type (Coupe/Sedan, SUV, Large SUV/Minivan) and is listed on our Site at the time of enrollment.

In accordance with California’s Automatic Renewal Law:

  • Clear disclosure before you pay. Before you provide payment information, we will clearly disclose the Plan’s recurring charge amount, the billing frequency, and that the Plan will automatically renew unless cancelled.
  • Affirmative consent. You must take an affirmative action (e.g., checking a consent box) — separate from any other purchase — to accept these automatic renewal terms.
  • Easy cancellation. You may cancel your Plan at any time by calling +1 (925) 263-6615, texting that same number, or emailing icyshine.detailing.ca@gmail.com. Cancellation will take effect at the end of the then-current billing period unless otherwise stated.
  • Retention of consent records. We retain records of your affirmative consent to automatic renewal for at least three years, or one year after your Plan is terminated, whichever is longer.
  • Advance notice of price changes. If we change the price of your Plan, we will notify you at least 7 and no more than 30 days before the new price takes effect, using the contact information you provided at enrollment. The notice will include the new price and instructions on how to cancel.
  • Annual reminder. We will send you an annual reminder of your Plan, its terms, and how to cancel, regardless of whether any changes have been made.
  • Same-medium cancellation. You may cancel using the same method you used to enroll, or the method you typically use to communicate with us.

Refunds for unused service periods. If you have not used your scheduled detail for a given billing period (Monthly or Quarterly), you may request a refund for that period’s payment within 3 months of the charge date for Monthly plans, or within 10 days after the end of the billing period for Quarterly plans. Refund requests for prior, already-elapsed billing periods will not be honored, whether or not the corresponding service was used. A billing period is not eligible for a refund under this policy if the scheduled visit for that period resulted in a lockout or no-show on your part, as described in Section 5.

11. SMS Terms

We are not currently sending SMS text messages — booking confirmations and reminders go by email. If we introduce SMS messaging in the future, it will fall into the following categories, each requiring its own separate affirmative opt-in before any such messages begin:

  • Transactional: approximately one hour before your scheduled appointment, to notify you that your technician is on the way and will arrive at the scheduled time, as well as booking confirmations and appointment-related updates.
  • Marketing/promotional: offers, seasonal discounts, and updates about our services and membership program.

Message frequency varies based on your bookings and preferences. Marketing messages will only be sent between 8:00 AM and 9:00 PM Pacific Time. Message and data rates may apply from your mobile carrier. To opt out of a message category, reply STOP to any message in that category, or contact us by any reasonable means. For help, reply HELP or contact us at icyshine.detailing.ca@gmail.com. Withdrawing SMS consent does not affect your ability to book Services with us through other channels. Consent to marketing messages is not a condition of purchase.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or related to the Services shall not exceed the amount you paid for the specific Service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

We are not responsible for: pre-existing damage or defects; undisclosed vehicle modifications; defective, worn, or previously-repaired paint or clearcoat; loose or damaged trim not caused by our work; or personal items left inside the vehicle in violation of Section 6.

Nothing in these Terms limits our liability for damage caused by our gross negligence, willful misconduct, or fraud, or for any other liability that cannot be limited or excluded under California law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hleb Staver d/b/a IcyShine Detailing from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: your breach of these Terms; your failure to accurately disclose the vehicle’s condition as described in Section 6; or your misuse of the Services, including but not limited to providing false or misleading information at booking, using the Services for any unlawful purpose, or knowingly placing our technician in an unsafe situation.

Similarly, we agree to indemnify and hold you harmless from third-party claims arising directly from our gross negligence or willful misconduct in performing the Services.

14. Professional Conduct

We maintain a zero-tolerance policy for verbal or physical abuse directed at our staff, including threats, harassment, or discriminatory language. If our technician reasonably determines that such conduct has occurred, we may terminate the Service immediately and may decline to accept future bookings from you.

If the Service is terminated under this Section after work has already begun, you remain responsible for payment for the portion of the Service actually completed, as reasonably assessed by our technician on site; any amount paid in excess of that portion will be refunded to you.

If you disagree with a determination made under this Section, you may request a review by contacting us at icyshine.detailing.ca@gmail.com within 48 hours; we will consider any additional information you provide, including your own account of the events.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-laws principles.

16. Dispute Resolution

Informal resolution first. Before filing any formal claim other than a small-claims court action, you agree to contact us at icyshine.detailing.ca@gmail.com and attempt in good faith to resolve the dispute informally for at least 30 days.

Binding arbitration. If the dispute is not resolved informally, you and we agree to resolve, through final and binding arbitration, any dispute arising out of or relating to the use, payment, or provision of the specific Service you booked with us. This arbitration provision does not extend to disputes unrelated to that specific transaction. Arbitration will be administered in the State of California under the rules of a recognized arbitration provider. Arbitration will be conducted under the arbitration provider’s consumer rules, and we will pay all arbitration fees and costs that exceed the amount you would have paid to file the same claim in small-claims court. For disputes within the jurisdictional limit of small-claims court, we reserve the right to require that the dispute be resolved in small-claims court instead of arbitration. Each party waives the right to a jury trial and to participate in a class action, to the extent permitted by law. Nothing in this Section waives your right to seek public injunctive relief in court where such a waiver is prohibited by California law. This arbitration provision does not apply to small-claims court actions, which either party may bring instead.

Delegation. Any dispute about whether a particular claim is subject to arbitration under this Section shall be decided by the arbitrator, not a court, except for disputes about the validity or scope of the class action waiver, which shall be decided by a court.

California Complaint Assistance. If any complaint with us is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

17. Modifications to These Terms

We may update these Terms from time to time. The “Last Updated” date above will be revised when changes are made. Your continued use of our Services after changes are posted constitutes acceptance of the updated Terms.

For material changes that affect active Plan subscribers — including changes to pricing, cancellation terms, or dispute resolution — we will provide notice by email or SMS (per your communication preferences) at least 15 days before the change takes effect.

18. Miscellaneous

Severability. If any provision of these Terms is found invalid or unenforceable by a court or arbitrator, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement. These Terms, together with any order details confirmed at booking, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements or understandings, written or oral.

Assignment. We may assign these Terms, in whole or in part, in connection with a sale, transfer, or reorganization of our business. You may not assign these Terms without our prior written consent.
